O presente trabalho pretende abordar a teoria da unidade do valor, enquanto teoria geral da interpretação. Ao superar a suposta divisão entre direito e moral, considerando a atividade interpretativa o elemento central de uma teoria normativa de todo o empreendimento humano, Dworkin evidencia as limitações do positivismo jurídico concebido por Hart em fornecer soluções adequadas aos “casos difíceis” e amplia o espectro para se encontrar uma “resposta correta” aos casos concretos em uma teoria normativa atrelada à moralidade política, manifestada pela (...) atividade interpretativa, cujo sentido será o valor atribuído pelo intérprete a um determinado fato ou objeto. O presente ensaio visa apresentar de forma breve e modesta uma introdução à filosofia da mente, deste modo, abordaremos os seguintes tópicos: I) a relevância e a contribuição do dualismo para a filosofia da mente, posteriormente surgindo a reflexão sobre mente-cérebro; e, finalmente, II) o argumento do zumbi filosófico. A partir desta apresentação conclui-se que os tópicos levantados sobre a relevância do dualismo para a filosofia da mente e debate em torno do argumento do zumbi filosófico contribua para a inquietação (...) e investigação sobre a mente. Resumo: O artigo enfoca duas questões abordadas pelo transhumanismo: imortalidade e longevidade. A primeira parte apresenta alguns contornos do programa transhumanista e a sua motivação. A segunda discute até que ponto a promessa de imortalidade não pode ser cumprida pela ideia de fazer o upload do cérebro na internet. Neste ensaio apresentamos o conceito de vida para o filósofo e médico francês Georges Canguilhem (1904-1995) e, posteriormente, desenvolvemos uma reflexão deste conceito, estabelecendo um paralelo entre a emergência da tecnociência e o transumanismo. Na primeira parte do ensaio, foram selecionados trechos das obras de Canguilhem, O normal e o patológico, O conhecimento da vida e o verbete “vida” escrito para a Encyclopédie Universalis. Sobre o verbete daremos atenção para a quarta interpretação sobre a vida proposta pelo filósofo. Além dos (...) textos escolhidos, utilizaremos artigos de especialistas que aprofundem a filosofia de Georges Canguilhem. Na segunda parte, apresentaremos, de modo geral, o surgimento e as implicações éticas da tecnociência na sociedade contemporânea. Na terceira parte, apresentaremos uma possível origem do transumanismo e o instigante e complexo debate em torno deste movimento. Neste tópico apresentaremos as contribuições de filósofos alinhados ao pensamento de Canguilhem e filósofos que refletem sobre o movimento transhumanista, tais como João de Fernandes Teixeira, Natasha Vita-More e Nick Bostrom. Na conclusão, apresentaremos a relevância do diálogo entre as áreas do conhecimento como a filosofia, ciências da vida e tecnologia para compreendermos os meandros da sociedade contemporânea.Palavras chave: Georges Canguilhem; vida; tecnociência; transhumanismo. The transition and adaptation of students to higher education involve a wide range of challenges that justify some institutional practices promoting skills that enable students to increase their autonomy and to face the difficulties experienced. The requirements for this adaptation were particularly aggravated by the containment and sanitary conditions associated with coronavirus disease 2019. With the aim of promoting academic success and preventing dropout in the first year, a support program was implemented for students enrolled in two courses in the (...) area of education at a public university in northern Portugal during the first semester of 2020/2021. Three sessions of 50/60 min were implemented, namely, the first session focused on the verbalization of the demands, challenges, and difficulties of the transition, and the second and third sessions focused on the difficulties of academic adaptation and academic performance. Data from a dropout risk screening instrument and from the activities performed during sessions were analyzed. The main results point to student satisfaction with the content and the activities of the sessions and their usefulness. Students report not only high satisfaction levels with HE attendance, but also some emotional exhaustion due to academic activities. The continuity of the program is recommended with some improvements in its planning to ensure a more definitive version of the program in the next two years. (shrink)

The U.S. Court of Appeals for the Fifth Circuit ruled, in United States u. Texus Tech University, 171 F.3d 279, that the Eleventh Amendment bars a private citizen from bringing a qui tam action in federal court against a state, absent federal intervention.Intervenor Carol Foulds was a dermatology resident at the Texas Tech Health Services Center. While a resident, Foulds examined patients, made diagnoses, and prescribed treatments for patients. Foulds alleged that she and other residents performed these medical services without (...) the supervision of staff physicians. Foulds further alleged that, after residents performed these services without physician oversight, staff physicians signed charts and Medicare and Medicaid billing forms certifying that they personally performed or supervised the administration of these services. Foulds estimates approximately 500,000 false claims occurred in a span of ten years.In 1995, Foulds filed a qui tam action with the U.S. District Court for the Northern District of Texas. As regulated by the False Claims Act, 31 U.S.C. § 3729, the complaint remained under seal. (shrink)

ObjectiveThis study aims to analyze sociohistorically how the normative patterns of hegemonic masculinity produced impacts on men’s health/mental health in the context of the COVID-19 pandemic.MethodsA qualitative study from a socio-historical perspective was conducted with 50 men based on an online survey. A semistructured form was applied. The data were analyzed by the Collective Subject Discourse method, interpreted in the light of the context of epidemic disease and hegemonic masculinity.ResultsThe experience of the pandemic exposed the normative patterns of masculinities from (...) the consummation of acts representative of the pandemic context, which incited men to deny the existence of COVID-19 disease and to delay the understanding and adoption of measures to protect and control COVID-19. As a repercussion, men presented conflicts in the regulation of emotions; presented emotional suppression; were more reactive; felt threatened regarding the loss of the role of family provider, virility; and revealed a sense of invulnerability, added to the weakening of self-care.ConclusionThe discourse revealed that the men’s behaviors are consistent with the characteristics of hegemonic masculinity, but express signs of recognition that this behavior causes harm to themselves and their health. In romantic relationships, individual differences are determinant factors for relational quality. Specifically, romantic attachment and difficulties in emotional regulation influence each other and may have predictive potential for the perceived dyadic adjustment level. This paper aims to identify the developmental parallel between behavioral patterns built since childhood and the construction of the emotional regulation skills that characterize them. Our analysis was based on the attachment theory and the concepts of romantic relationship and DA. In this way, we sought to further (...) the understanding of relationship dynamics, beyond the usual focus on a single element and on associative relationships, and by exploring other effects among the different dimensions of relational functioning. In particular, we explored the predictive ability of emotional regulation patterns in discriminating between RA styles, and their impact on the quality of romantic relationships, in the anticipation of dyadic adjustment variations. Allan Hazlett challenges the philosophical assumption of the value of true belief. He critiques the view that true belief is better for us than false belief, and the view that truth is "the aim of belief". An alternative picture is provided, on which the fact that some people love truth is all there is to "the value of true belief".

The concepts of meaning and mental content resist naturalistic analysis. This is because they are normative: they depend on ideas of how things ought to be. Allan Gibbard offers an expressivist explanation of these 'oughts': he borrows devices from metaethics to illuminate deep problems at the heart of the philosophy of language and thought.

This essay presupposes that Friedrich Nietzsche and Rudolf Carnap champion contrasting reactions to the fact that, throughout history, persons have been engaged in metaphysical disputes. Nietzsche embraces a libertarian reaction that is in agreement with his anti-democratic aristocratic political views, whereas Carnap endorses an egalitarian reaction aligned with his democratic and socialist political views. After characterizing these reactions, the essay argues for two claims. The first claim is that the stated contrasting reactions are to be considered, not only by the (...) few scholars who are interested both in Nietzsche’s and Carnap’s writings, but by a far larger group that includes those who have addressed the continental-analytic gap; those who are concerned with the development of contemporary philosophy; and/or those who are interested in the writings of Michel Foucault, Jacques Derrida, David Lewis and/or Peter van Inwagen. The second claim is that we have to entertain a synthesis of Nietzsche’s libertarian and Carnap’s egalitarian reaction in order to overcome the continental-analytic gap. (shrink)

Alain Ehrenberg’s essay, “The American Self versus the French Institution,” describes the emergence in France of what Ehrenberg calls a new discourse on psychological suffering. The kind of ‘suffering’ is not examined in detail, other than suggesting that it is experienced as social and moral misfortune, and represented in psychiatric diagnoses and interventions. If I understand Ehrenberg correctly, these misfortunes are products of a changing social reality: the progressive weakening of social ties, a diminishing sense of community and shared obligation, (...) and the valorization of personal autonomy and separateness. Fin de siecle Vienna was once memorably described by Karl Kraus as a "proving ground for the destruction of the world." In the decades leading to the World War that brought down the Austro-Hungarian empire, the city was at once an operetta dream world masking social and political problems and tension, as well as a center for the far-reaching explorations and innovations in music, art, science, and philosophy that would help to define modernity. One of the most powerful critiques of (...) the retreat into fantasy was that of the philosopher Ludwig Wittgenstein, whose early career in Vienna has helped frame debates about ethical and aesthetic values in culture. In Wittgenstein's Vienna Revisited Allan Janik expands upon his work Wittgenstein's Vienna (co-authored with Stephen Toulmin) to amplify a number of significant points concerning the genesis of Wittgenstein's thought, the nature of Viennese culture, and criticism of contemporary culture. Although Wittgenstein is the central figure in this volume, Janik places considerable emphasis on other influential figures, both Viennese and non-Viennese, in order to break down some of the persistent stereotypes about the philosopher and his surrounding culture, especially the myths of "carefree" Vienna and Wittgenstein the positivist. The persistence of these myths, in Janik's view, stems in part from the inability of many historians to differentiate past from present in the evaluation of intellectual currents. Janik reviews a number of figures overlooked in assessing Wittgenstein: Otto Weininger, Kraus, Schoenberg, Nietzsche, Wagner, Ibsen, Offenbach, and Georg Trakl. All of these, Janik demonstrates, are absolutely necessary to understand what was at stake in the debates on aestheticism and the critique of a modern culture. Wittgenstein's efforts to recognize the limits of thought and language and thus to be fair to science, religion, and art account for his place of honor among critical modernists. The philosopher and novelist Ayn Rand is a cultural phenomenon. Her books have sold more than twenty-eight million copies, and countless individuals speak of her writings as having significantly influenced their lives. This essay focuses on the similarities between Nietzsche’s and Carnap’s views on metaphysics, without ignoring their obvious differences. The essay argues that Nietzsche and Carnap endorse but interpret differently an overcoming metametaphysics characterized by the conjunction of the following three claims: an overcoming of metaphysics ought to be performed; this overcoming is to be performed by adopting a method of linguistic analysis that is suspicious of the metaphysical use of language and that interprets such use through a different use of (...) language which aims to avoid metaphysics; and this overcoming contributes to the political task of resisting “diseased” metaphysical practices and promoting “healthy” non-metaphysical practices.
